Les personnes transgenres obtiennent ainsi le droit de se marier, d\u2019h\u00e9riter, de divorcer et d\u2019adopter des enfants.<br \/>\nCette d\u00e9cision place la plus grande R\u00e9publique du monde au m\u00eame stade que l\u2019Allemagne, premier pays europ\u00e9en \u00e0 autoriser, depuis le 1er Novembre 2014, l\u2019inscription d\u2019un sexe \u00ab\u00a0ind\u00e9termin\u00e9\u00a0\u00bb sur les certificats de naissance (The Guardian , citant le S\u00fcddeutsche Zeitung).<br \/>\n\u00abLes transgenres sont des citoyens de ce pays et ont droit \u00e0 l\u2019\u00e9ducation et \u00e0 tous les autres droits\u00bb, d\u00e9clare le juge Radhakrishnan devant les m\u00e9dias. C\u2019est ainsi que la Cour a ordonn\u00e9 l\u2019octroi des m\u00eames aides sociales et aides \u00e0 l\u2019emploi que les autres groupes minoritaires. L\u2019acc\u00e8s \u00e0 la sant\u00e9 et \u00e0 d\u2019autres m\u00e9canismes sociaux sera \u00e9galement favoris\u00e9.<br \/>\nCette d\u00e9cision donne cependant naissance \u00e0 un surprenant paradoxe. En effet, l\u2019homosexualit\u00e9 est encore un crime passible de dix ans d\u2019emprisonnement jusqu\u2019\u00e0 la prison \u00e0 vie en Inde. Cette loi remonte \u00e0 1860, lorsque sous la tutelle britannique fut promulgu\u00e9 l\u2019article 377 du Code p\u00e9nal indien, criminalisant les \u00ab relations charnelles contre l\u2019ordre de la nature \u00bb.<br \/>\n\u00ab (L\u2019article 377) constitue une violation des droits fondamentaux \u00bb, tel \u00e9tait cependant le jugement rendu par la Haute Cour de Delhi le 2 juillet 2009. Cette jurisprudence fut applaudie par les membres de la communaut\u00e9 LGBT, per\u00e7ue comme l\u2019enclenchement de l\u2019engrenage juridique vers la l\u00e9galisation des relations homosexuelles sur tout le territoire.<br \/>\nC\u2019est donc avec stupeur que les militants accueillirent, le 11 D\u00e9cembre 2013, la d\u00e9claration de la Cour Supr\u00eame d\u2019Inde criminalisant \u00e0 nouveau les \u00ab relations contre nature \u00bb. Surprise m\u00eal\u00e9e de fureur pour les quelques 2,5 millions d\u2019homosexuels que compte le pays et leurs sympathisants, qui voyaient d\u2019ores et d\u00e9j\u00e0 la balance de Dame Justice pencher en leur faveur.<br \/>\nNul ne sait quand la question sera reconsid\u00e9r\u00e9e, les rouages du syst\u00e8me l\u00e9gislatif \u00e9tant particuli\u00e8rement mal huil\u00e9s.
